4. Client Obligations

Clients are expected to:

Provide accurate information regarding the garden’s current condition and desired outcomes.
Ensure access to the property during scheduled service times.
Obtain necessary permissions for any structural changes requiring local authority approval.
Maintain an environment that is safe for our staff to perform their duties.

5. Payment Terms

Payment for services is due as follows:

Deposit: A non-refundable deposit of 30% is required upon agreement acceptance.
Final Payment: The remaining balance is due upon completion of the service.

Payments can be made via bank transfer, credit card, or other accepted methods. Late payments may incur additional charges.

6. Cancellation Policy

Clients may cancel services by providing at least 48 hours’ notice. Cancellations made within 48 hours of the scheduled service may be subject to a cancellation fee equivalent to 20% of the total service cost.

7. Liability

Gardening Fitzrovia strives to perform services with the utmost care and professionalism. However, we are not liable for:

Pre-existing conditions or damages not caused by our services.
Natural events such as storms or pests that affect plant health post-service.
Any indirect or consequential losses arising from the use of our services.

Our liability is limited to the total amount paid for the services rendered.

8. Intellectual Property

All designs, plans, and materials created by Gardening Fitzrovia remain the intellectual property of the company. Clients are granted a limited license to use these materials for personal purposes. Any commercial use requires explicit written permission.

9. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which Gardening Fitzrovia operates. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts located therein.

10. Changes to Terms and Conditions

Either party may terminate the Agreement with written notice if the other party breaches any material term of these Terms and Conditions. Upon termination, clients are responsible for payment of any outstanding fees for services rendered up to the termination date.
